Real Estate Changes Coming Soon!

The National Association of Realtors (NAR) is in the process of settling a monumental lawsuit with the Department of Justice (DOJ) regarding real estate buyer commissions.

There are so many questions regarding the changes and lawyers are still in the drawing room working out details with the DOJ. 

But this is what we know right now:

  • As part of the settlement, NAR agreed to prohibit offers to compensate the buyer's agent on multiple listing services (MLS)

Compensation is only prohibited from being listed on MLS – fees are not prohibited from being advertised on marketing materials or negotiated from closing costs.

  • Buyers will now be responsible for negotiating and signing a commission rate agreement to see a listing that is not an open house.

Buyer agents need to communicate the value they provide as a buyer’s agent upfront.

  • Seller will now have the “option” to opt out of paying the commission for the buyer’s agent.

Does not necessarily mean sellers will do that; Having a well-represented buyer is an advantage to seller to close the deal efficiently.  (The ultimate goal)

  • This change is scheduled to be in effect July 15th 2024.
